CURRENT CASE STATUS

A Settlement has been proposed in a class action lawsuit that alleges that Airborne Health, Inc. (and other defendants) (“Airborne”) falsely advertised certain therapeutic properties, including the ability to cure or prevent the common cold, when marketing products under the Airborne brand name, as listed below. Defendants deny any wrongdoing or illegal conduct but have agreed to settle the litigation. This website provides information on the lawsuit and proposed Settlement. Click here to download the complete Settlement Agreement.

On November 29, 2007, the District Court for the Central District of California entered an order preliminarily approving the proposed Settlement. Click here to download that Order. The Court has scheduled a hearing on June 16, 2008 at 10:00 am, to consider final approval of the Settlement.

The hearing will take place at:

United States District Court
Central District of California -- Eastern Division
Riverside Courthouse, Courtroom 2
3470 Twelfth Street
Riverside, CA 92501

This website will be updated periodically. Please check back on this website for updates on the status of the Settlement approval.

That is just sad. They are a great company, and do give out freebies from time to time. I will not be doing this.

What is sad about it? I've paid for this product that was falsely advertised. I dont feel bad at all getting my money back, i have taken this and gave it to my children to try and prevnt colds. By the way what makes a great company giving out free samples or selling a product that does what they advertise it does. You dont have to be a part of it but I'm sure that other people that bought their product will feel like they were scamed.

Thanks for the info, but I never purchased any. Come to think of it, I never got any of the freebies either!:p

Unbelieveable what some people sue for.

In your case, yes, you are entitled to it. I am just saying that for people who have never bought the product, but are now going to be trying to get it for free...

:claps: What great info! Thanks so much for the post .... It's about time the consumers win one against the big cooporation commie bastards and their bogus claims!!!!!!!

I totally agree - with both of you! Although there are - lets face it - TONS of frivilous lawsuits filed and fradulant claims made to get in on the settlement, consumers purchase products with their hard earned money in good faith, assuming the products will work as claimed. Consumers should be afforded some protection against the deep-pocket, mass marketing companies who are not only ripping them off, but potentially jeapordizing their health as well! Revertmastc made a great choice to post this in community forums as a heads up to members, and not in the freebie section for potential opportunists.

I have bought this multiple times because i go to football games up north and everytime i get a cold i get pnuemonia so I thought i would try it but it never seems to do much good.....I even tried with my son but he bever gets sick anyways so I couldnt tell ya if it was effective for him but Thank you for the info!

Good Luck! :)

I guess we need to add her to the list too.
:theyareon

Shouldn't we have our rights protected from any one making false claims about a product? :noidea:

I don't know, guys... I've bought this before... numerous times (mostly at Costco in bulk). I don't think I've ever used it, but hubby does. I'm not sure it really does much, but I never expected it to cure or even really prevent a cold. It's like taking echinacea or Vitamin C. It has some properties that will help, but it's not like a vaccine or anything.

I won't be participating in this lawsuit, simply because I never thought they made it seem like it was a "wonder drug" or anything. As a matter of fact, believing in a "miracle cure" is... well... delusional, to say the least.

I'm taking airborne right now... so far I've only had really yellow pee, but I have a lot of friends who swear by this stuff!

I did get their freebies! Those pixie sticks tasted disgusting! And they were suppose to be for children!

Your body can only take a certain amount of vit C at a time, it dumps the rest in your urine. That's one reason why it glows
