Insurance claims???

I just had my first damn accident today :mad: .
The guy was parked and pulling out and hit me... he didnt check his blind spot. He hit me as I was passing him.

So... he came out screaming and I screamed back. Plenty of witness' unfortunately they all left when the police came.

Police officer told me he was at fault, cause he was not in the lane of traffic while I was already one. He should have looked.

Also I provided information of one witness across the street to the police, whom saw the accident in a coffee shop...

What happens to my insurance? will my premiums go up even if its not my fault?
 
Your premiums should not go up if it is 100% not your fault.
 
Ahh, that's a shame. How long have you had your license? What kind of car do you have, and what's the damage? :(

i have had my license for over 2 years now... yea im only 23... lol.
i have a WHITE galant, and the damage is minimal as he was pulling out on to me.

there 2 major and noticeable dents now because of him and RED paint on the dmged parts. :mad:

Yes, they may go up. When filling out forms for new insurance last time I was asked if I had an accident in the last 3 years even if I was not at fault. I said yes even though I was hit by a woman going the wrong way on a ONE WAY :mad:

My insurance went up, not by much but they never asked me who was at fault, they didn't care just wanted to charge me more.

now this is only when you are filing a with new insurance company or renewing? when i renewed they didnt ask any questions, i just noticed my policy premium went down about 500 bucks -=) :claps:
 
Yes, it only happened to me when I changed.
 
Ahh, that's a shame. I get my license in a month (I'm 16) and I scheduled my test the other day. I have a 1992 Diamante which is my pride and joy, so I'd be very upset if someone hit it, especially since if the damage is bad, it'll probably be totaled. The book value isn't too much, but we're the original owners and the car has 91,000 miles and change. There's not one dent on it, we keep our cars very clean. I'm able to use the car because we own two cars, and my dad has a company car through work, so having the extra car is surely a nice luxury. :D

Good luck with processing your claim and getting everything figured out. Let us know what happens.

That happened to me, my ex gave me a car and I drove it 4 miles when I was hit. Car was totaled.

hmm question:

rather it be totaled or live with the dents???

i rather have it totaled and get a new car from the claim... :zip:

then again for it to be totaled it must be a dangerous accident... which isnt so good if you think about it. :eek:

but i hate driving a car with dents, sigh. :mad:
 
That was my first kind of accident too. Some girl backed out into my and she had the nerve to say that it was my fault.

In most cases, your insurance won't go up if you're not at fault. But switching insurances or renewing your policy, they'll probably check your file, and all they care about is that you were involved.

However, even though it was totally the other person's fault, be prepared for a long wait before you see any compensation come your way. Last year, my parked car was involved in an accident involving two other cars. After hell of actually trying to track down the 2 people involved from their cryptic messages left on my car, I had a choice to file a claim through my own company or go after the guilty party. Obviously seeing the painful road ahead of actually getting one of the 2 to admit guilt, I filed through my own company thinking, "Hey, drop bucket loads of my paycheck to my insurance, now it's time to get their lawyers to do all the work for me." Long story short, it took 7 months before I saw my deductabile back again.

If you could fix it without re-painting or replacing damaged parts, that would be the best. Nothing is better than the original paint, unless what you have is not the original paint. I would go to the fix-a-dent type of place and check their work.

Fortunately your damage seems small in value. If your car is damaged badly, the other driver doesn't have insurance or his/her policy is not enough to cover the damage, and you don't have uninsured/underinsured motorist coverage, then your collision/comprehensive will kick in, and that's when your rate will go up...
 
Yea it's possible that your insurance premiums could go up. Depending on the insurance company they may raise your rates just because you were "involved" in an accident where you were at fault or not.

I'd switch companies if they raised my rates because I was involved in an accident where I was not at fault. They wouldn't deserve my business. I've been driving for 16 years without any accidents that were my fault or any tickets whatsoever.

By the way, Erik, you sure act very mature for a soon-to-be 16-year-old. :claps:

If its under $750 it shouldn't affect anything.

Why don't you ask your agent? Then you can get the right answer.
 
Well, I'm already 16, in Pennsylvania we get our license at 16.5. :)

Well for me it was easy, the insurance company gave me $1600 and I had friends that worked for an auto body shop only cost me a 6 pack to fix. The paint was never fixed. ;)

All depends on how much you care about how your car looks.

My car was parked and hit in Winter 03, and still not a word from my insurance! The damage wasn't bad, but I would like to get my money. My insurance company(GEICO) is supposed to give me $1000, but my deductible is $1000 so what now? I've been a loyal customer for 10 years!!! :mad:
 
Are you supposed to get $1,000 because your damage was $2,000? Or did they say the damage was $1,000? If the damage is $1k and your deductible is $1k, then you break even. Turn them into your state's insurance commission if you feel otherwise.
