The K'NEX "Vertical Vengeance" Instant Win Game Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. The K'NEX "Vertical Vengeance" Instant Win Game ("Promotion") begins at 12:00:00 PM (Noon) Daylight Savings Time ("DST") on Monday, October 2, 2006 and ends at 11:59:59 AM DST on Thursday, November 2, 2006. The Promotion is intended for participation only in the United States and shall be construed according to, and governed exclusively by United States law. Do not participate in the Promotion if you are not physically located in the United States at time of entry. Entry in the Promotion does not constitute entry into any other promotion, contest or sweepstakes. By participating in the Promotion, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of K'NEX ("Sponsor"), which shall be final and binding in all respects. By participating in the Promotion, participants agree to release, discharge and hold harmless Promotion Entities (defined below), their respective parents, affiliates, subsidiaries, divisions, retailers, agencies and their respective officers, directors, employees and agents, from any and all damages whether direct or indirect, which may be due to or arise out of participation in the Promotion or any portion thereof, or the acceptance, use/misuse or possession of prizes.
1. ELIGIBILITY: The Promotion is open only to legal residents of the 50 United States residing in the 50 United States and the District of Columbia (excluding Puerto Rico and all other territories). Entrants must be 6 years of age or older at the time of Promotion registration. Employees, officers and directors of K'NEX Industries, Inc, Integrated Media Concepts (collectively, "Promotion Entities"), their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies, their immediate families (parent, child, sibling & spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Promotion. Void in Puerto Rico, all other territories and where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.
2. HOW TO PLAY THE INSTANT WIN GAME: LIMIT: Limit one (1) Instant Win game play per person or email address per day. Subsequent Instant Win game plays in the same day from the same person or email address will be disqualified. Any attempt by a person to enter the instant win game more than once in the same day and/or with multiple email accounts may result in disqualification at the discretion of the judges or Sponsor upon prize verification. For the purposes of the Promotion, a day shall mean a 24-hour period, beginning at 12:00:00 AM (Midnight) ET and ending at 11:59:59 PM ET, with the exception of the first day which starts at 12:00 PM on Monday, October 2, 2006, and the last day which ends at 11:59:59 on Thursday, November 2, 2006.
To enter and play the K'NEX "Vertical Vengeance" Instant Win Game, visit http://www.knex.com and click on the promotional button. Entrants 13 years of age or younger will be required to submit their e-mail address and their parent or legal guardian's e-mail address. The parent or legal guardian of such entrants will receive an e-mail notifying them that their child has entered the sweepstakes, and also giving information on removing their child from the sweepstakes, if they wish. Entrants over the age of 13 will be required to complete and submit the online entry form. After submitting the form all entrants will receive one Instant Win Game Play. All registrants must first enter their date of birth, including month, day and year. THE INSTANT WIN GAME ARE OPEN ONLY TO REGISTRANTS AGE 6 AND OLDER AT THE TIME OF REGISTRATION.
After entering registration information and clicking on the submit button, you will receive one (1) Instant Win Game Play. If the game play states you have won a prize, you win an Instant Win Game Prize, subject to confirmation, verification, compliance with these Official Rules and final approval from the judges or Sponsor. If you are a Prize Winner, an email will be sent to you or your parent/legal guardian with instructions on how to redeem your prize. All Instant Win prizes must be redeemed by 11:59:59 PM on Wednesday, November 15, 2006. Proof of play and/or winning will not be deemed to be proof of winning by judges or Sponsor.
Returning Players: You can return to enter and play the Instant Win Game once a day for the duration of the Promotion. Returning Players can log in by simply filling in their First Name, Date of Birth and E-mail Address and click the "Enter" button.
Entries will be deemed made by the authorized account holder of the email address submitted at time of entry. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner must provide Sponsor with satisfactory proof that he/she is the authorized account holder of the email address associated with the potentially winning entry. In the case of a minor, the potential winner's parent or legal guardian may be the authorized account holder. Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, illegible or corrupted are void and will not be accepted. Information collected from entrant is used only for the purpose of the prize drawing and to notify winners, and will not be re-used, sold or shared in any manner by Promotion Entities or any third parties unless entrant has elected to receive additional information and promotional material from Sponsor or a third party. Once the Promotion has ended, all information supplied by entrants will be removed from the database. 3. INSTANT WIN GAME PRIZES AVAILABLE and ODDS OF WINNING: There are a total of one hundred thirty (130) prizes available in the Instant-Win Game. Odds of winning Instant-Win prizes depend on the number of eligible entries received and the day and time of game play. The Quantity, Prize Description/Average Retail Value (ARV) of a specific prize in the Instant-Win Game are as follows:

IN THE EVENT OF PRIZE UNAVAILABILITY, PRIZES MAY BE SUBSTITUTED BY THE INDEPENDENT JUDGES FOR ITEMS OF EQUAL OR GREATER ARV. Gift certificates are subject to the issuer's terms and conditions.
4. DISQUALIFICATION: Sponsor is not responsible for technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software or web site. Sponsor is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, for incorrect or inaccurate entry information, howsoever caused, or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any aspect of this Promotion, as solely determined by the judges, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate entrant's eligibility to participate in the Promotion. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Only the stated number of prizes will be awarded. If for any reason more entrants receive an "Instant Winner" notice than the number of prizes stated herein, Sponsor reserves the right to award only the number of prizes stated in the Official Rules for that category. In no event will more prizes be awarded than those listed in Rule #3.
5. TAX INFORMATION: All federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winner. Disputes: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Pennsylvania, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Pennsylvania.
