My husband and I are in the process of renting to owning our house that we lived in for two years since we have moved to Florida.A couple of days ago,someone rang our doorbell.This man shoved this huge packet in my hand.I got served.The reason for me being served I found out was nothing that I did,but it seems that our landlord who owns our house and some others,hasn't been paying the mortgage on the house and now our house is in foreclosure.Great.Just a week or less before Christmas.Because I am married,my husband also got served.I also found out that we are the 7th person whose home is now in foreclosure.From a reliable source,we found out that he has been taking all of his renters money they pay every month,we pay $1200 a month and putting the monies in a Swiss bank account for his personal use.Now we were told from his office manager that we were going to get some papers from their office so that because of his dishonesty,the house would be ours free and clear.Today as my daughter and her boss,the landlord's former office manager,left to run errands,we were told our landlord wants his rent,of which I feel he shouldn't get.I don't know what to do.I think we need a lawyer.:prey::rant:
 
Oh that is horrific! Try contacting the "State's Attorney's Office!" With so many folks falling prey to this prank, they would chew on this like a baby's candy! Call your local "Legal Aid" they offer discount legal advice, and, sometimes for free. Plus....contact your local TV station, and, report the story to them! Again, the more exposure for you and the others in the similar situation, the faster the conflict resolution. Good luck. :)

Not only will the publicity get you a faster resolution, but often lawyers etc will come forward and offer to help for free. The local new station often will help and investigate deeper for a better story ~ that could work out to your benefit!

I agree. The tv station will do a story about it. Don't let him get away with this!!

This is awful MrsK am so very sorry there are such rotten people in the world that would do something like this and the nerve of the guy to want his rent! Good luck I pray you get the help you need to get this guy, to bad our legal system can't put a hold on his swiss bank account the slimey no account :rant::rant::rant::rant:

I doubt that very much.

Unless the person has the liquid assets to be seized and put into the homes and then through some desperate act of charity he pays off the mortgage and gives you the home, you will not be getting that home "free and clear". I'm stunned the office even said something so blatantly false. The home is owned by the bank, not the person who hasn't been paying the mortgage. It isn't the office's to give to anyone. For them to say what they did was cruel.

From what you've posted, I'm baffled why you haven't gotten a lawyer yet! Once you got served, you should have gotten a lawyer.
 
Get a lawyer and don't pay your landlord a dime! Tell him you need that money for rent and a deposit on another place since this one is being yanked out from under you because he couldn't pay his mortgage!
 
The problem is we cannot afford a lawyer :nonod:nor can we come up with the deposit to move into another home.So we don't know what else to do.
We have paid $ 34,000 in rent so far towards this house.I know I don't want to become homeless.I have some health issues and well:cry:....
 
i say go to the media~ newspaper something and use the money he wants for rent as a down payment for a lawyer instead!
 
That's so not fair!

I agree that you want to get a lawyer. Maybe you can get one pro bono whose representing others in the same situation.

I know something similar was happening to people in Chicago and there was a law that was in the process of passing to prevent evicting the residents of foreclosed homes. I think the rental money went from going to the "owner" to the bank.

Other than the media, calling the State Attorney General, trying to find a lawyer, etc... you are hosed. Only a lawyer can help you here. If you can't afford one, find one!!!! that will do the work for free.

I would disregard any advice telling you to not pay the rent. Unless your rental agreement is voided, you probably, by law (and regardless of whether it is fair or not), owe the money unless a lawyer can tell you otherwise. Not paying the rent can probably set yourself up for problems down the road... unless a lawyer tells you differently.
 
Almost any lawyer does pro-bono (free) work. Find one who will at least take your case on commission, and have him open a escrow account. Put your payments in that account until the situation is settled. That way you're legally making the payments.

Not sure what kind of a deal you made with your landlord, but are you sure you want to trust him? I'd be leary.....I hope you obtained legal advice/services, it would be in your best interests to do so.

Seems wildly improbable and definitely suspect. Don't want to go into details? In the OP you noted that the house is in foreclosure and the Landlord is spending your money on something else. Now you saying all is well... no wait, that you are "very happy". In what world do you reside where going from point A to B would seem to require no details... I mean unless the Landlord has given you back every dime and has cleared you from the agreement.

And how can you afford $1200 a month for housing, but can't afford a lawyer?
