Who should I complain to?

Here's the story...I made a purchase online, the seller ships it via USPS, the USPS delivered the package, but just left it outside of my door at 8am in the morning thus it got stolen. Well, my question is who's at fault? I'm going to file a complaint, but can't determine who's at fault. I'm not going to pay something for nothing right? I believe I should file a complaint against the seller, since it is his duty to deliver the package no matter how...is that wrong?
 
Please don't take offense, but if you were aware of package thefts near you and you didn't request a delivery requiring a signature or if you didn't instruct the PO to deliver the package to a neighbor or have them put the package in the backyard or somewhere safe, you might be at fault. But I'd still complain to everyone.

If this was a first time, I'd check with my neighbors since one might have seen the package and took it home so it didn't get stolen and then they may have forgot to tell you (FYI it happened to me and I didn't get the package for a couple weeks from my neighbor).

Either way, I'd complain to everyone until I got my package.
 
Yeap, thefts happen. Now, I put a note on my door to leave any package through the side door. So far so good, the only thing is I have to check often if I'm expecting any package since they don't leave any notice on my door (makes sense so that nobody knows whether I have a package or not). I also added "pets are not outside the house" on the note for security measure...

Actually this is the first time that ever happened to me. Most of the time, the shipping is via UPS thus signature is required and if it's USPS, it's usually in the afternoon. Also,I wasn't expecting the package anytime soon because it was said to be shipped later. I figure the seller would require signature confirmation, but he didn't...thus I do believe he should be at fault here. I guess I'll file a complaint against everyone...hahaha...that's a good idea!!!
 
No ones at fault but the person who took it.

Just contact the seller, the seller should have bought insurance on it regardless. If not they'll just have to suffer a loss and replace it.

If not I hope you paid for it by Credit, cause at least then you can just do a dispute/charge back.
 
First, you should report the theft of the package to the USPS and your local law enforcement. Then, you should report it to the seller, he will say it wasn't his fault, but tell him you have told the USPS & The Law. Then ask any neighbors that a package was taken from your door so that they can be aware of this.
 
Just wondering how do you know if it was actually STOLEN if there was not a delivery confirmation or signature required. What if the Postal Service is just running a day behind. Just wondering how you know it was stolen if you never physically saw it on your porch (i assume you never saw it or you would have picked it up :p )

They might've left the little pink piece of paper in his regular mailbox telling where they left the box that would'nt fit in the mailbox, also, the neighbors might've gotten off his porch, so no one would steal it, and they forgot to give it to him, or are waiting to see him outside
 
There is a delivery confirmation...but no signature requirement. The seller is refusing for replacement/refund. Thanks for all the feedbacks...
 
Is this an EBAY/Paypal transaction?

The seller has the responsibility to get the item to you. If you never received it, it's on the seller.
 
it isn't the sellers responsibility to purchase insurance for the item, it's the buyers choice. i have been selling on ebay for years and i always state in my auctions that i am not responsible for lost, stolen or damaged goods unless insurance is purchased.

if you paid via paypal, you could TRY to file a claim but I do not see it happening in your favor. not to sound harsh or rude.

call the post office and have a talk with them although i am unsure what they will be able to do for you as well.

seems like a no win situation.
 
Paypal almost always finds in favor of the Buyer. And if the Buyer files a claim with the Post Office and has proof to present to Paypal, then the seller will end up losing.
No matter what you state in an auction, Paypal has excellent buyer protection in any situation.
 
I am not too keen on the law but theft of mail, whether it be from your mailbox or from your front porch, is a federal offense. Notify your post office that delivers to you and if they can't help, try to find out how to get in touch w/the main branch. I know of a kid that got a felony for tampering w/a mailbox. Maybe something can be done to retrieve your package. It always helps deter theft when you have a very big dog in your yard or on your porch.

I always wondered when a package becomes personal property. Like if it's on your property anywhere isn't it then your responsibility? Let's say the cops find that a person has 2 lbs of drugs on their porch, wouldn't they rightly assume that those belong to whoever is there?
 
Theft is theft no matter where it occurs. But theft of mail is still a federal offense regardless if it was taken out of the box or off the porch. If you open another persons mailbox to put mail into it that you got in your box by mistake, you could still get jail or a fine.
 
one thing to consider is- do you want a huge investigation over this matter? i mean are we talking about something worth your time and inconvenience? not asking what it is specifically, but i'm just saying if you're talking about a tube of toothpaste, is it worth having to talk to usps, cops, or whoever investigates mail theft...
 
Wow...so many replies...well, it's not from eBay purchase, but I did pay via paypal though. I have filed a complaint with the USPS, but they won't do anything unless the package is insured...in which the seller does offer thus I couldn't purchase it. I also filed a complaint with paypal...hopefully they will hope out some way...

Here are to answer some questions:

How do you know they left the package out there, if there was no package out there?

because I have the delivery confirmation number in which it shows that it was delivered...

do you want a huge investigation over this matter? i mean are we talking about something worth your time and inconvenience? not asking what it is specifically, but i'm just saying if you're talking about a tube of toothpaste, is it worth having to talk to usps, cops, or whoever investigates mail theft...

hahaha...no, it's not something like toothpaste. It's something that I was getting for someone as a present...not so expensive, but I still don't want to pay something for nothing...
