There are so many "scams" on eBay where people sell a "brand new box" of a Playstation 3 or in this case "a picture of" a cell phone.

I always thought it's somewhat fair since it states so on the ad although you know the seller's intentions.

See how judge judy takes it.

The seller is a theif and an idiot. Thanks for the wake up call.
I hope the buyer gets her refund. I went to small claims court for a contractor. We won the case and he filed bankruptcy. He took out money and ran. The little work he completed did not pass inspection. We had to hire a new contractor to take down what the original contractor started. We never saw a dime from our claim.
 
This is ridiculous. Pure sensationalism. I don't understand how people can watch this, let alone participate.
 
If people are too dumb to read the full description of a PS3 starting at $20.00 (or wii, xbox, whatever- I didnt watch this, Judge Judy makes me want to squirt myself in the eye with bleach) then its their own damn fault.

If the auction clearly says its only a box, or a picture, or a manual, or whatever, then I dont think that the seller should be held liable for the buyer's refund. Period.


Ok, I fast fwded to almost the end.. Why didnt the defendant say that the 4.90 oz was the weight of the photos, and the packaging; since it all had to be mailed, that was the total weight. What a moron.

I don't know how you can say that these two women deserved to be victims of fraud, LiveSquid.

Allowing "scammers", and "con-artists", to get away with this type of ruse offends the spirit of the law and shocks the conscious. If these two people can be taken advantage of in this way, then it could happen to anyone.

Judge Judy is usually spot on with how she decides these cases. Her ruling was in this case.
 
Of course no one deserves to be the victim of fraud. What I said was, if the auction clearly states that it is only a box, a picture, or whatever, its not fraud. Its people who didnt read the auction fully or correctly. And that is not the lister's fault. Even if it was her intention, if the buyers had properly read the description, they wouldve known that it was for whatever it was for, and wouldnt have bought it. If they did read it and they still bought it, then thats their problem. Even if they realized it after the auction and before paying, they still had the option to not pay.
 
I agree with Squid.. How can you be a victim? if the ad clearly states box, pictures, I've even seen envelopes for sell on ebay. I have ran across several of these on ebay. Always read the description very carefully. If unsure, ask the seller a question or don't bid. And I have always found that the scandalous ads are very clear in what they are selling ...... nothing.

These two women were victims of fraud and defamation in this case because the defendant said the weight of the item for sale was 4.90 ounces when it was not and the scammer posted false statements about the two women on their feedback pages.

Additionally, the plaintiff alleged that there were 8 other victims of this defendant on ebay, which if you watched the clip, the plaintiff talked about it. And the plaintiff said that there was some sort of Attorney General investigation going on, which would seem reasonable as the defendant was using the internet and the mail to facilitate her scam.
 
As I also said, 4.90 ounces could have been the total weight of photos, packing, envelope, etc. Judy didnt weigh the photos. She doesnt know how much they weigh. Unless she has some uncanny way of knowing exactly how to weigh up to five ounces in .01 oz increments in her bony little hand. And we all know thats 99% probability to not be the case. This show is edited beyond belief. You can bet that this whole ordeal didnt only take 15 minutes. And dont you wonder what they removed?

That sucks that eight other people were also too stupid to read the auction fully, properly, etc. I wonder why the plaintiff had no proof to offer (and why she wasnt asked for any) regarding all of her attempts to have the authorities take action, the ADA, other "victims", etc.

Do you really believe everything you hear on TV by people you dont know, who are desperate? I hope not. Theres no telling what was edited, what was a lie, etc. It could be like Jerry Springer where the producers actually script the interviews.
