THE HOME DEPOT “DRIVE TO E-CIRCULAR INSTANT SPIN TO WIN” PROMOTION (THE “PROMOTION”) OFFICIAL RULES AND REGULATIONS
This Promotion is intended for viewing and participation in the 50 United States, or Washington D.C., only and shall be construed and evaluated according to the laws of the 50 United States or Washington D.C. Please do not proceed if you are not located in the 50 United States or Washington D.C. at time of entry. Void in Puerto Rico and where prohibited.

1. PROMOTION PERIOD: Starting April 26, 2006 at 12:00:01 AM Eastern Time (ET) and ending June 30, 2006 at 11:59:59 PM (ET), (the "Promotion Period").
2. ELIGIBILITY: To enter and be eligible to win, you must be a legal resident of the 50 United States, or Washington, D.C., be 18 years of age or older, and have a valid email address. Persons in any of the following categories are NOT eligible to participate or win prizes: (a) any person who, at any time on or after April 26, 2006, was or is a director, officer, employee, agent of The Home Depot, Inc. (the “Sponsor), or any of its subsidiaries, divisions, or affiliated companies, or service agencies, or independent contractors of the Sponsor; (b) individuals engaged in or employed by any company engaged in the development, production or distribution of materials for the Promotion (collectively the “Promotion Entities”), and (c) persons who are immediate family members (defined as biological or step-mother, father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household (i.e., live in the same household for at least three of the 12 months preceding the start of the Promotion Period, whether related or not), as any person in any of the preceding categories.
3. HOW TO ENTER & PLAY: To enter the Promotion, go to www.homedepot.com/spintowin (the “Promotion website”) and follow the instructions to register. When registering, you will be required to accept these Official Rules and enter your full name, date of birth, zip code and a valid email address. Once you have successfully registered, you will receive one (1) Instant Win game play. You will also be automatically enrolled for the Sponsor’s online circular subscription. This online circular provides you with information and updates on The Home Depot special savings offers and exclusive online offers. This online circular is provided free of charge and you may opt-out of receiving it at any time. To play the Instant Win game, click on the “SPIN” button. This will activate the spinning of the ‘saw wheel’. Once the ‘saw wheel’ stops spinning, you will see a message on the results page informing you whether or not you are an eligible winner of an Instant Win prize. If you receive a winning message, you will be eligible to win the prize stated, subject to verification of; eligibility, game play and compliance with the terms of these Official Rules. If you do not receive a winning message, you are not eligible to win a prize. A Security Identification Code (SIC) will appear on the game play results page. Limit of one (1) game play per person or email address throughout the Promotion Period. If it is discovered that you attempted to enter more than ONCE, all of your entries will be declared null and void, and any prize you might have been entitled to will not be awarded.
4. PRIZES: At the outset of the Promotion, at total of 2,507 Instant Win prizes will be available to be won. There will be 2,507 random, computer-generated winning times during the Promotion Period, one (1) random computer-generated winning time for each of the Instant Win prizes. Each day throughout the Promotion Period (there are 66 days in this Promotion), thirty-eight (38) Instant Win prizes will be seeded. The exception is the last day (the 66th day) on which thirty-seven (37) prizes will be seeded. If you are the first player to play the Promotion at or after a computer-generated winning time, you will be a potential winner of an Instant Win prize, subject to verification. The odds of winning an Instant Win Prize are based upon the number and timing of eligible entries received. Limit of one (1) Instant Win Prize per person or email address throughout the Promotion Period. Total ARV of all prizes available to be won: $74,500.00.
5. HOW TO CLAIM YOUR PRIZE: As a condition of accepting a prize, all potential winners will be required to provide their full address and telephone number at the Promotion website (street address, city, and state), after they receive the potential winning message. Prize claim instructions will be provided to winners on the Promotion website. All winners will receive their prize at the address provided, via standard United States Post within approximately ten (10) to twelve (12) weeks from the date their full address information was submitted. Prizes valued at $250 or greater will be sent via registered mail and require a signature upon delivery. All unclaimed prizes will not be awarded. Prizes are not transferable or redeemable for cash and must be accepted as awarded, with no substitutions of any kind, except at Sponsor’s sole discretion, who reserves the right to substitute a prize of comparable or greater value. All federal, state and local taxes, if any, are the winner’s responsibility. By accepting a prize, winners consent to Sponsor’s or its designees’ use of their names, addresses (city and state), voices, statements relating to the Promotion or Sponsor, and photographs or other likenesses, without further compensation, notification or permission, in any publicity carried out by Sponsor or any related entities in connection with this Promotion, in any and all media now or hereafter known throughout the world in perpetuity, except where prohibited by law. If a potential winner is found to be ineligible, declines to accept the prize, or in the event that a prize confirmation or prize is returned undeliverable, the prize will be forfeited. Potential winners may be required to furnish proof of identification.
CONDITIONS OF ENTRY:
6. Entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements and, (ii) agree to be bound by the decisions of the Sponsor, made in their sole discretion, which shall be final and binding in all matters relating to this Promotion. Entrants who have not complied with these Official Rules are subject to disqualification.
7. Entries generated by script, macro, robotic, programming, or any other automated means are prohibited and will be disqualified. Sponsor is not responsible for late, lost, damaged, stolen, misdirected, mutilated, garbled, illegible or incomplete postage-due submissions of Promotion materials, which may be judged void by the Sponsor in its sole discretion. Proof of transmission (screenshots or captures of game play etc.) and/or mailing does not constitute proof of delivery. All entries become the property of Sponsor and in no case shall be returned to sender.
8. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
9. Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participating in the Promotion, by the acceptance, possession, or use of any prize awarded, including not limited to claims/damages for personal injury, or property damage.

Without limiting the generality of the foregoing, Sponsor reserves the right in its sole discretion to cancel, modify or suspend this Promotion at any time, if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, integrity or proper play, of the Promotion.
13. Sponsor and the Promotion Entities do not warrant that access to or use of the service will be uninterrupted. Sponsor and the Promotion Entities are not responsible for any problems that may arise, including but not limited to; (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, Web sites, or other connection, availability or accessibility problems arising in connection with or over the course of the Promotion; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of any prize or in any prize notification documents; or (d) for any errors of any kind in connection with the Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion; or (f) damage to a user's system occasioned by participation in this Promotion or downloading any information necessary to participate in this Promotion.
DISCLOSURES:
14. Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Participants engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won.
15. Should any game play indicate that you are entitled to win a prize and that representation is later deemed to have occurred as a result of an error of any kind in connection with this Promotion, or as a result of fraud, then your eligibility to entitlement of such prize will be decided in accordance with the terms and conditions of these Official rules.
16. If a dispute arises relating to prize won, a combination of factors will be assessed in determining if you are in fact eligible to win a prize; i. the Play Receipt including the unique SIC, and its corresponding play data in our database will be reviewed to determine the legitimacy of the claim, ii. the Promotion Judges will be consulted to compare the pre-generated game data with the game play data you are presenting or have generated. Ultimately it will be the results of the Promotion Judges’ analysis, which will determine your entitlement to any prize. The review of any such dispute will not commence prior to two weeks following the Promotion end date noted herein. In the event the Promotion Judges’ analysis reveal valid prize claims are greater than the number of prizes available set forth in these rules, there will be a random drawing amongst all eligible prize claimants whose claims have not yet been redeemed, to award the remaining number of advertised prizes in the prize category in question. Prizes will stop being awarded in the event Sponsor becomes aware of an error respecting the number of prizes. 17. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Georgia without regard to Georgia’s conflicts of law principles. All entrants consent to the jurisdiction and venue of the State of Georgia.
18. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
