If you owned a Palm personal digital assistant model m100, m105, or m125 ("Palm PDA") manufactured by palmOne, Inc. (formerly Palm, Inc.) ("Palm"), this notice may be important to you. A proposed settlement has been reached in a lawsuit in which plaintiff claims that: (a) the Palm PDAs may be defective in that they sometimes lose data during the process of replacing batteries even when the user follows Palm's recommended procedure; and (b) Palm allegedly communicated and/or failed to communicate and disclose certain facts and circumstances in connection with data loss.

As part of the settlement, Palm has agreed to exchange, at Palm's expense, the Palm PDA of any owner who: (a) returns the allegedly defective Palm PDA; (b) provides a sworn statement that the owner lost data while replacing batteries in accordance with Palm's recommended battery replacement procedure; and (c) provides adequate claim documentation (as described in the Claim Form) and proof of membership in the class. The replacement unit will be a new or refurbished unit of the same or a higher model. Palm reserves the right to inspect any Palm PDA submitted as part of this settlement. If Palm's records or its inspection of the Palm PDA show that the cause of data loss during the battery exchange process is due to abuse, mishandling, or misuse of the Palm PDA, the claim may be denied.

Claims must be submitted on the Claim Form provided below, and must be submitted within six months after Final Approval (subject to change by the Court). No Settlement Class Member may submit more than one (1) claim with respect to each Palm PDA owned by the Settlement Class Member, each claim must relate to a separate Palm PDA unit, and only one claim will be accepted for any one PDA. All claims are subject to verification and validation by Palm. Claims will not be processed until after Final Approval.
 
You know, I have this EXACT problem with my Palm m105. I can swap the batteries in under 10 seconds and everything is lost. Thank goodness for syncing.

Where is the claim form? I have gone thru this twice and cannot find it. Please advise.

Bump. The claim must be submitted by February 22, 2006!
 
Date change

Actually, because it took so long to sign the agreement, the claim period has been extended to July 18, 2006.

Thanks for the update cpierce and WELCOME to Spoofee. I am still awaiting a mailing label from them. My Palm sits unused on my computer desk right now.

I mailed in the claim form a looooonnng time ago. You mentioned that you are waiting for a mailing label... Did they send correspondence to you asking to send it in or something? Just wondering as I have not heard anything from them.

The claim form states that Palm will send a mailing label out when they are basically ready to receive the defective units. I sit here waiting like you. I haven't heard anything at all as of yet.
 
Thanks for the clarification. I did not read it that close as I figured I wouldn't hold my breath on this. I will just keep waiting and maybe one day I will get a surprise.

Update!!!

Got the envelope to send the Palm back today! If you haven't recieved yours, you might be getting it soon.
 
I just got my envelope today too. Am sending the defective Palm back now. Have you received your unit back Visionary? I guess you have about two weeks left to wait.

Actually I have been lazy and the envelope is still sitting there with the junk Palm. Thanks for the reminder, I am going to try to send it in today!
